1. About These Terms
These Terms of Use govern your use of the NoStatic application and the services and features made available through it.
NoStatic is provided by Nicolas HOMS, individual entrepreneur operating under the trade name Inchoms.
By accessing or using NoStatic, you acknowledge that you have had the opportunity to review these Terms of Use and agree to use NoStatic in accordance with them.
If you do not agree with these Terms of Use, you should stop using NoStatic.
2. About NoStatic and Publisher
NoStatic is a mobile application designed to help users reduce sedentary behavior by providing configurable reminders and related wellbeing features.
NoStatic is developed and published by Nicolas HOMS, individual entrepreneur operating under the trade name Inchoms, established in France.

References in these Terms to “NoStatic,” “Inchoms,” “we,” “us,” or “our” refer, as applicable, to the NoStatic application and to Nicolas HOMS operating under the trade name Inchoms.
3. Purpose of NoStatic
NoStatic is designed to help users reduce prolonged sedentary periods by providing configurable reminders that encourage regular movement, posture changes, screen breaks, and other simple wellbeing-related actions.
Users can configure reminder schedules, active periods, frequencies, and available reminder types according to their own preferences and routines.
NoStatic is intended to support general wellbeing and everyday habits. It does not monitor users continuously, does not assess their physical condition, and does not make decisions on their behalf.
NoStatic should be used as a supportive reminder tool and remains under the user’s control at all times.
4. Health and Medical Disclaimer
NoStatic is intended for general wellbeing and informational purposes only.
NoStatic is not a medical device and does not provide medical advice, diagnosis, treatment, or professional healthcare services.
The reminders, suggestions, and information provided by NoStatic are general in nature and are not intended to replace advice from a qualified healthcare professional.
You are responsible for deciding whether and how to follow NoStatic reminders based on your own circumstances, comfort, and physical condition.
If you have a medical condition, experience pain or discomfort, or have concerns about whether certain movements, posture changes, screen breaks, breathing exercises, or other wellbeing activities are appropriate for you, you should seek advice from a qualified healthcare professional.
In case of a medical emergency, do not rely on NoStatic and contact the appropriate emergency services.
5. Notifications and Reminder Reliability
NoStatic uses local notifications and device scheduling features to deliver reminders according to the settings configured by the user.
The timing and delivery of reminders may depend on the operating system, device manufacturer, battery optimization settings, notification permissions, background activity restrictions, device state, software updates, and other system-level conditions outside the control of NoStatic.
Although NoStatic is designed to provide reminders as reliably as reasonably possible, we do not guarantee that every reminder will be delivered at the exact scheduled time or that notifications will always be delivered without interruption.
Users remain responsible for their own device settings and for deciding whether NoStatic is suitable for situations where precise timing may be important.
NoStatic should not be relied upon for emergency alerts, medical monitoring, safety-critical notifications, or any situation where delayed or missed delivery could result in harm.
6. Permitted Use
NoStatic may be used for personal, lawful, and non-commercial purposes in accordance with these Terms of Use.
You may configure and use NoStatic’s available features, including reminder types, schedules, frequencies, active periods, and other settings, according to your own preferences and routines.
You may use NoStatic on devices that you own or are authorized to use, subject to the terms and technical requirements of the relevant operating system and application store.
Your use of NoStatic must comply with applicable laws and regulations and must not interfere with the normal operation, security, or integrity of the application or related services.
7. Prohibited Use
You must not use NoStatic in any unlawful, fraudulent, abusive, or harmful manner.
In particular, you must not:
- attempt to gain unauthorized access to NoStatic, its code, systems, infrastructure, or any related service;
- interfere with, disrupt, damage, overload, or circumvent the normal operation or security of NoStatic;
- reverse engineer, decompile, disassemble, modify, or attempt to extract the source code of NoStatic except where such activity is expressly permitted by applicable law;
- reproduce, redistribute, sell, sublicense, or commercially exploit NoStatic or any substantial part of it without prior authorization;
- use NoStatic in a manner that infringes the rights of Inchoms, other users, or third parties;
- use automated means, scripts, bots, or similar tools to misuse, manipulate, or interfere with NoStatic or related services;
- use NoStatic for any purpose that could reasonably compromise the security, availability, integrity, or proper functioning of the application.
We may take reasonable measures to protect NoStatic and related services where misuse, abuse, security risks, or violations of these Terms are identified.
8. Intellectual Property
NoStatic, including its software, source code, design, visual elements, graphics, icons, text, branding, logos, and other original content made available through the application, is owned by or licensed to Nicolas HOMS, operating under the trade name Inchoms, and is protected by applicable intellectual property laws.
Your use of NoStatic does not transfer to you any ownership rights or intellectual property rights in the application or its content.
Subject to these Terms of Use, you are granted a limited, personal, non-exclusive, non-transferable, and revocable right to use NoStatic for its intended purpose.
Except where expressly permitted by applicable law or with prior authorization from Inchoms, you may not copy, reproduce, modify, adapt, distribute, publish, sublicense, sell, commercially exploit, or create derivative works from NoStatic or any protected part of it.
The names “NoStatic” and “Inchoms,” their associated logos, and other branding elements may not be used in a way that suggests an affiliation, endorsement, or authorization that does not exist.
9. Availability, Updates and Changes
We may update, modify, improve, suspend, or discontinue all or part of NoStatic from time to time in order to maintain, secure, improve, or develop the application.
Updates may include changes to features, functionality, design, compatibility, technical requirements, or supported operating system versions.
Some updates may be necessary to maintain the security, reliability, or proper functioning of NoStatic.
We do not guarantee that every feature or version of NoStatic will remain available indefinitely, or that the application will remain compatible with every device, operating system version, or third-party platform over time.
Where reasonably possible, we will seek to avoid unnecessary disruption and to preserve users’ locally stored data and settings during updates.
NoStatic may also be temporarily unavailable or partially limited due to maintenance, technical issues, operating system restrictions, device conditions, or circumstances outside our reasonable control.
10. Disclaimer of Warranties and Limitation of Liability
NoStatic is provided on an “as available” basis and is intended to support general wellbeing and everyday habits.
While we make reasonable efforts to maintain the reliability, security, and proper functioning of NoStatic, we do not guarantee that the application will always operate without interruption, delay, error, incompatibility, or technical issue.
To the extent permitted by applicable law, Inchoms is not responsible for losses or damages resulting solely from circumstances outside its reasonable control, including operating system behavior, device restrictions, notification delivery limitations, third-party platform changes, or user device settings.
NoStatic is not intended for emergency, medical monitoring, safety-critical, or other uses where delayed, missed, or incorrect information could result in harm.
Nothing in these Terms excludes or limits any rights, remedies, guarantees, or liabilities that cannot lawfully be excluded or limited under applicable law, including mandatory consumer protection rights.
Where Inchoms is legally responsible for a failure to provide NoStatic in accordance with applicable law or these Terms, any limitation of liability in this section applies only to the extent permitted by applicable law.
11. Governing Law and Consumer Rights
These Terms of Use are governed by the laws of France.
However, if you are a consumer residing in another country, you may also benefit from mandatory rights and protections provided by the laws applicable in your country of residence. Nothing in these Terms is intended to exclude, restrict, or override any such mandatory rights.
If you have a question, complaint, or dispute relating to NoStatic, we encourage you to contact Inchoms first so that we can attempt to resolve the matter directly and amicably.
Where applicable, consumers may have access to alternative dispute resolution or consumer mediation mechanisms provided by applicable law. Where Inchoms is required to provide access to such a mechanism, the relevant information and contact details will be made available in accordance with applicable legal requirements.
Nothing in these Terms limits your right to bring a claim before a competent court where such a right is provided by applicable law.
12. Changes to These Terms
We may update these Terms of Use from time to time to reflect changes to NoStatic, applicable laws or regulations, technical requirements, business practices, or the services and features made available through the application.
When these Terms are updated, the revised version will indicate the date of the latest update.
Where a change is material and where reasonably appropriate, we may provide additional notice through NoStatic, our website, or another suitable communication method.
Changes will apply from the date indicated in the updated Terms, unless applicable law requires a different approach.
Your continued use of NoStatic after updated Terms become applicable will be subject to the revised Terms, without prejudice to any rights or protections that cannot lawfully be waived or modified without your explicit agreement.
